The Role and Significance of Public Discussion in the Law-Making Process

Abstract

The article analyzes the role and significance of public consultation in the rule-making process from theoretical-legal and comparative-legal perspectives. It examines the main principles and forms of public consultation, as well as the importance of involving stakeholders in the rule-making process. The institutional mechanisms of public participation established in the United States and the European Union, as well as the approaches of the Organisation for Economic Co-operation and Development (OECD) to stakeholder engagement, are comparatively analyzed with the practice of Uzbekistan. In addition, the article considers the constitutional and legal foundations of public consultation in Uzbekistan, the procedures for its organization, its digital infrastructure, and the early-stage notification mechanism introduced in 2025.
